Foreigners who are not entitled to freedom of movement and have a residence permit in accordance with section 23 (2) of the Residence Act, which entitles or permits them to pursue gainful employment for a period of at least six months, can receive child benefit for their children who have also entered Germany. Child benefit is taken into account as income and is offset against any social security benefits granted under Books II and XII of the German Social Code.
